Mr. Blair (rightly) didn't look to the second Security Council resolution to establish the action's legality. Just provide "an insurance policy." The action's legality appears not to have been in dispute, only its popularity.

Memo: President Bush said: "The US was thinking of flying U2 reconnaissance aircraft with fighter cover over Iraq, painted in UN colours. If Saddam fired on them, he would be in breach."

But US warplanes, enforcing the UN-established no fly zone, were fired upon regularly. No need for such ridiculous attempts at trickery, which wouldn't have stood to scrutiny anyway. So Bush would have stood up and said, "they fired on a UN spy-plane!" To which the other UN members would say, "whose spy plane was that?"
